This contribution deals with the analysis of the phenomenon of land grabbing - that is, the acquisition or rental of large lands by public or private investors - and its potential implications on the observance with the norm on territorial sovereignty and the right to land of indigenous peoples. The first part of the article is devoted to the systematic classification of the phenomenon at issue and to the identification of its characteristics, i.e., the reasons underlying it, its objectives, the subjects involved, the main interpretative approaches. The second part examines the issue of the compatibility of land grabbing regimes with the exercise of territorial sovereignty and the right to land of the populations involved in the implementation of such regimes. In the conclusions it is underlined the need to encourage sustainable investments, through the preparation of an international code of conduct and the adoption of national normative and institutional systems, aimed at adequately regulating the acquisition of lands on a large scale.

Oggetto del presente studio è l’analisi del fenomeno del land grabbing - ovvero, l’acquisizione o l’affitto di terreni di ampie dimensioni da parte di investitori pubblici o privati - e delle sue potenziali implicazioni sul rispetto della norma sulla sovranità territoriale nonché sul rispetto del diritto alla terra dei popoli indigeni. La prima parte dello scritto è rivolta all’inquadramento sistematico del fenomeno ed all’individuazione dei suoi tratti caratterizzanti, ovvero le ragioni che lo determinano, i suoi obiettivi, i soggetti coinvolti, i principali approcci interpretativi. Nella seconda parte è esaminata la questione della compatibilità dei regimi di land grabbing con l’esercizio della sovranità territoriale ed il diritto alla terra delle popolazioni coinvolte dalla realizzazione di tali regimi. Nelle conclusioni è posta in risalto la necessità di favorire investimenti sostenibili, attraverso la predisposizione di un codice internazionale di condotta, in uno con la previsione di sistemi nazionali normativi ed istituzionali, tesi a disciplinare in maniera adeguata l’acquisizione di terre su larga scala.
