Waving the flag of the embryo’s right to life and considering assisted reproduction as a remedy to infertility, the Italian legislator has failed to address more serious issues and has lost sight of the present interconnectedness of countries. In this light, erecting barriers and setting limits that are too strict only serve (as history has shown) to make the “closing rule” of the legal system extremely fragile. The complexity of the issues that law 2004/40, as approximate as it may be, has left unsolved has thus forced courts to a number of interventions that have deeply affected the intent outlined by the legislature. Comparative law has shown the need to avoid limits that are too strict, with the risk of leaving to courts the task of making them more permissive. Argentina's experience is, in this sense, very interesting. The Argentinian legislator (cfr., art. 558, Código Civil y Commercial 2014) acknowledges the unavoidable problems linked to reproductive technology and, of course, is very concerned about the legal issues that these techniques raise.

Sbandierando il vessillo del diritto alla vita dell’embrione, e considerando la fecondazione come un rimedio alla sterilità, il legislatore italiano ha mostrato di non affrontare questioni piú serie e di non rendersi conto che il mondo ha perso confini. In quest’ottica, erigere barriere, fissare limiti troppo rigorosi serve solo (come la storia insegna) a rendere estremamente friabile la «regola di chiusura». La complessità degli interrogativi che la legge ’40, nella sua approssimativa formulazione, ha lasciato irrisolti ha così costretto i giudici ad una serie di interventi che hanno inciso profondamente sul disegno delineato dal legislatore. La necessità di evitare argini troppo rigorosi, con il rischio di affidare ai giudici il compito di allentarli, è profilo che ben si ricava dall’esperienza comparatistica. Interessanti le indicazioni che vengono dal Código Civil y Commercial del 2014, in cui il legislatore (art. 558) prende atto della inevitabile proiezione normativa della tecnologia della riproduzione, e si preoccupa delle problematiche che questa tecnica solleva, ma nella prospettiva della costruzione del rapporto di filiazione.
