The essay focuses, in comparative perspective, on the definition of the new social objectives of the European Union, right after the drafting of the constitutional treaty. The theme is indissolubly bonded to the evolution of the concept of the fundamental rights. In effect, the problem of the safeguarding of fundamental rights in the European political-juridical area represents a relatively recent reality: if Community legislation, in fact, has always unquestionably represented a privileged source for political and social progress for the European demos, however this result is nothing more than a mere reflection of policy choices initially destined to create an economical reality, rather than a socio-political one.
