The emergency legislation can act as an acceleration factor of a paradigm shift of pecuniary debts, shaped on the abstract favor creditoris, in the direction of sustainability in relation to the conditions in which, in practice, the debtor pays. Moreover, some important milestones reached on the level of justice of contractual relations and mandatory relations are the precipitate of crisis phases that have spanned the last century. The strengthening of the concerted way in the management of private debt relationships would give the obligatory relationship - core, in turn, of the economic system - that flexibility and adaptability that has long characterized post-modern and contemporary society. The mimesis between the societas horizon and the categories of the ius should be able to provide more effective responses to the need to contain, also in terms of interpreted relationships, the social risks associated with economic difficulties.
