This paper focuses on the consequences of the United Kingdom’s withdrawal from the European Union in terms of the participation in local elections of citizens residing in a Member State other than that of nationality, in light of the new legislative framework and the case law of the Court of Justice of the European Union. In the judgment in case C-673/20, Préfet du Gers, the Court reaffirms the “inseparable and exclusive” link between the possession of the nationality of a Member State and the retention of the EU citizenship status. Considering this link and the Treaties unchanged, any hypothesis of the definition of EU citizenship as an “autonomous” status cannot be deduced.
