Regrettably at the center of national and international debates, fueled by the resurgence of recurring news reports, gender-based violence has become a pressing concern in modern society. Among the evolutionary trends of Western countries in combating this phenomenon, the Spanish legal system is considered to be pioneering for having enacted, as early as 2004, an organic law on “Medidas de Protección Integral contra la Violencia de Género”, which represents the first normative reference model on said topic at a European level. This paper aims at delving into the aspects of Spanish legislation and comparing them with the solutions adopted by the Italian lawmakers, with the purpose of identifying key strengths and aspects which require further attention.
