The essay rereads in an evolutionary key the topic of testamentary dispositions containing the clause “Titius heres esto, si Caius voluerit”, moving from a shrewd insight of Mario Allara, who envisages a particularly significant reconstruction of it, which, however, he remodels after the entry into force of the ‘42 code. The focus of the reflection is the profile of the qualification of such clauses, about which he diverges from the prevailing orientation, elaborating a thesis with peculiar application corollaries.
