The contribution analyses the political aspect of the idea of happiness, with the aim of transforming it into a positive right guaranteed by any legal system, and verifying the possibility of building a happier society, making use of the suggestions of one of the greatest exponents of the Southern Enlightenment, Gaetano Filangieri, who aspired to a new political and civil order, advocating the idea of a Constitution capable of ensuring public happiness no longer as the object of good principles, but as the expression of human rights and the affirmation of the ideas of liberty and equality.
