This paper focuses on the comparative analysis of the mechanism of constructive no-confidence, as regulated in some current Constitutions of continental Europe. More specifically, after a preliminary reflection on the origin and function of the institution and a summary of cases in which it has found concrete application at the national level, the analysis turns to its key procedural aspects, as evidenced by the constitutional texts examined, complemented by the respective parliamentary regulations, and concludes with an evaluation of the results of the overall comparative investigation based on the different structure of the institution and its relevance within the various constitutional systems.
Il presente lavoro si incentra sull’analisi comparata del meccanismo della sfiducia costruttiva, come disciplinata in alcune Costituzioni vigenti dell’Europa continentale. Più specificamente, dopo una preliminare riflessione su origine e funzione dell’istituto e un riepilogo di casi in cui ha trovato concreta applicazione limitatamente al livello nazionale, l’analisi si rivolge ai suoi aspetti procedurali salienti, come si evincono dai testi costituzionali esaminati, integrati dai rispettivi regolamenti parlamentari, per concludersi poi con una valutazione dei risultati della complessiva indagine comparata sulla scorta della diversa struttura dell’istituto e della sua rilevanza nell’ambito dei vari sistemi costituzionali.
