The essay analyzes the discipline of the so-called sports binding, as provided by Articles 31, Legislative Decree no. 36/2021 and 41, Decree Law no. 75/2023, as well as by federal regulations. After reconstructing the concrete problems underlying the cases under analysis, attention focuses on the role played by the rules established by sports federations and their correct placement within the unitary Italian-European legal system. The essay concludes with reflections on the possible constitutional and European illegitimacy of Article 41, Decree Law no. 75/2023
