The constant development and ever-increasing diffusion of technologies have led to a significant socio-economic transformation in recent decades. In the described context it should be noted that negotiation has always been influenced on different levels using new techniques and contracts that have evolved with the growth of increasing social needs. The assonance between technology, intended as a means for people to achieve a certain purpose, and contracts, as social instruments provided by law to regulate the autonomy and responsibility of individual subjects, becomes obvious. In negotiation, the major new phenomenon that has emerged, and has caught the attention of the academic community, is the so-called smart contract. Our research was carried out on this topic, by exploring in more detail the many issues that are still unsolved, with particular reference to the controversial legal qualification of the institution and its applicability to the traditional general regulations of the contract.
Lo sviluppo incessante e la diffusione sempre maggiore di tecnologie hanno determinato negli ultimi lustri una profonda trasformazione socio-economica. Nel descritto contesto va preso atto che la contrattazione è sempre stata influenzata a diversi livelli dall’uso di nuove tecniche e contratti evolutisi con lo sviluppo delle accresciute esigenze sociali. L’assonanza tra tecnologia, intesa come mezzo che consente all’umanità di conseguire un determinato obiettivo, e, contratti, quali strumenti sociali predisposti dal diritto per regolare l’autonomia e la responsabilità dei singoli soggetti, si appalesa d'altronde evidente. In ambito negoziale, il principale nuovo fenomeno che si è imposto, e, che ha attirato l’attenzione della dottrina, è sicuramente il c.d. smart contract. Su tale tema è stata svolta la nostra ricerca, mediante l’approfondimento delle molteplici problematiche rimaste insolute, con particolare riferimento alla controversa qualificazione giuridica dell’istituto ed alla sua adattabilità alla tradizionale disciplina generale del contratto.
