Article 5 of the EHDS Regulation enshrines the right of the natural person to enter information into their electronic health record, thereby acknowledging an active and participatory role in shaping their own care pathway. The provision, however, tempers such openness with the need to preserve the reliability of health data, requiring that information supplied by the data subject be clearly distinguishable from that recorded by healthcare professionals and precluding any direct alteration of the latter. The resulting framework is one of qualified informational self-determination, in which the expansion of the patient’s prerogatives is reconciled with the safeguarding of documentary integrity and clinical accountability.
L’art.

Abstract
Article 5 of the EHDS Regulation enshrines the right of the natural person to enter information into their electronic health record, thereby acknowledging an active and participatory role in shaping their own care pathway. The provision, however, tempers such openness with the need to preserve the reliability of health data, requiring that information supplied by the data subject be clearly distinguishable from that recorded by healthcare professionals and precluding any direct alteration of the latter. The resulting framework is one of qualified informational self-determination, in which the expansion of the patient’s prerogatives is reconciled with the safeguarding of documentary integrity and clinical accountability.I documenti in IRIS sono protetti da copyright e tutti i diritti sono riservati, salvo diversa indicazione.
