The economic and financial crisis has highlighted the fragility of the European framework, at the same time generating a complex institutional response. This paper examines the nature and the scope of some of these changes and specifically those concerning the relationship between the European Union and the Member States in the area of the “economic governance”. After a brief reminder of the normative measures introduced in the wake of the crisis concerning the coordination of economic policies, the control over the draft budgetary plans of the Member States and the mechanisms for financial assistance, an interpretation of the current institutional situation is given using two concepts elaborated by Michel Foucault: “pastorship” and “discipline”. This should allow for an understanding of the deeper sense of the new techniques of government in this area which, by their nature, have ended up involving also the Court of Justice and the national judges.
