The article offers a comparative analysis of some central issues of judicial review in the German and the Italian legal orders. In the first part three classic subjects of the judicial review procedure are examined (division of competences between administrative and ordinary courts, locus standing and intensity of judicial review). In the second part a new typology of litigations between private parties and public authorities (so-called informational litigations) are illustrated through the examination of the judicial procedure regarding the access to documents and the legal treatment of the secret and confidential information in judicial context.
