L’evoluzione della tutela dei diritti nei confronti delle agenzie europee. A proposito delle recente modifica dello statuto della corte di giustizia dell’Unione europea.

The paper analyses article 58a of the Statute of the Court of Justice of the European Union, introduced through Regulation 2019/629. This provision establishes a prior admission mechanism for appeals brought before the European Court of Justice against General Court decisions concerning the decisions of certain European Union agencies’ boards of appeal. A brief introduction to these boards of appeal is followed by an examination of some organisational and procedural shortcomings of the current regulation of these bodies that have been accentuated by this reform. Finally, art. 58a is contextualised within the normative contradictions and inconsistency that have characterised the regulation of rights protection against acts of EU agencies, and the possible tools that could guarantee greater coherence in this delicate area are briefly illustrated.
