La storia della magistratura è costellata di ricerche che, soprattutto (anche se non solo) in Italia, sono condotte con i metodi del tutto interni alla visione pangiuridica del mondo e vertono per lo più sulla ricostruzione degl’istituti normativi e sul funzionamento formale delle istituzioni giudiziarie. Ma l’analisi delle fonti ufficiali non è utile a scovare il potere occulto, il quale per definizione non lascia tracce, e quando lo fa ha lo scopo non di chiarire ma di depistare. Per questo la storiografia (soprattutto giuridica) sulla magistratura compie spesso errori di metodo che non centrano l’essenza del problema. Il nodo della questione, infatti, sta tutto nella trasformazione arcana della giurisdizione in potere politico, un potere che nega ufficialmente di essere tale e risulta dunque schermato e arcano, e di conseguenza incontrollabile e irresponsabile. Individuare i punti nevralgici della ricerca storica sulla magistratura significa quindi fare i conti con queste distorsioni storiografiche di fondo e proporre un metodo alternativo che sappia utilizzare strumenti di ricerca e d’interpretazione molto più ampi della mera analisi normativa. Entrano così in gioco, con trasversalità interdisciplinare, saperi che la cultura e l’ideologia dei giuristi tradizionalmente considerano alieni dalla purezza dello specifico giuridico e quindi insignificanti anche per la ricostruzione storiografica. Quest’ultima risente anch’essa fortemente di un positivismo acritico e tecnocratico e finisce con il deformare la corretta descrizione della realtà. La ricostruzione della storia della magistratura, al contrario, ha bisogno di un metodo che sappia coniugare l’interdisciplinarità con una visione di lunga durata e che riesca a superare un formidabile paradosso: far luce su un potere che per sua natura è destinato a restare protetto dall’invisibilità del buio. The history of the judiciary is studded with studies carried out, especially (though not only) in Italy, with the methods of a juridical overall perspective, and aim at reconstructing the normative institutes and the formal functioning of the judicial institutions. But the analysis of official sources is not useful to unearth the hidden power, which by definition leaves no trace, and when it does it is intended not to clarify but to mislead. Therefore the historiography (especially legal) on the judiciary often makes methodological mistakes that are missing the core of the problem. The heart of the matter, in fact, lies in the arcane transformation of the jurisdiction into political power, a power that formally denies to be such and therefore is understood to be disguised and arcane, and therefore out of control and unaccountable. To identify the crucial points of historical research on the judiciary therefore means to deal with these basic historiographical distortions and to propose an alternative method that employs research tools and hermeneutic tools much broader than mere normative analysis. New interdisciplinary elements that the culture and ideology of lawyers traditionally considered alien to the purity of the legal science, and therefore insignificant even for the historical reconstruction, enter the picture. Historical reconstruction is also strongly affected by an uncritical and technocratic positivism and comes to deform the correct description of reality. The reconstruction of the history of the judiciary, on the contrary, needs a method that combines an interdisciplinary approach with a long term vision, and is able to overcome a formidable paradox: to shed light on a power which by its nature is intended to be shrouded by the dark.

La ricerca storica sulla magistratura. Aspetti metodologici e linee prospettiche
