The essay analyzes the discipline provided for in the articles 6 and 12, d.l. n. 132 of 2014, which introduced new contractual tools for resolving family crisis. It dwells on the main interpretative and applicative problems posed by the new rules and focuses on the relationship between the principle of ‘physiological alternative resolution of disputes’ and the ‘public interest in the stability of the marriage bond’. The balance between the different interests protected by the Italian-European legal system allows to address the problem of the available nature of the ‘marital status’, in light of a changed set of values.
