O DIREITO À SAÚDE E À VIDA EM CONFRONTO COM O DIREITO À PROPRIEDADE INTELECTUAL DOS LABORATÓRIOS, NO ÂMBITO DA PANDEMIA DA COVID 19: A POSSIVEL QUEBRA DE PATENTES

A pesquisa traz uma grande contribuição ao “direito à vida” no contexto atual da pandemia provocada pelo COVID19. A pesquisa analisa que os objetivos dos laboratórios que produzem a vacina do COVID19, é unicamente comercial e, uma vez que ao desenvolverem o antídoto, se quiserem vendê-lo a lucros exorbitantes, desproporcionais ao custo e à margem de lucro aceitáveis, a quebra de patente compulsória deve ocorrer, como mecanismos de proteção aos Direitos Humanos. Assim, a pesquisa traz grandes contribuições à sociedade, vez que traz elementos jurídicos para, quando confrontarmos o binômio “direito à vida” e “direito ao lucro”; deve a vida, como bem jurídico mais importante do ser humano, suplantar o direito individual do lucro.

The research makes a major contribution to the “right to life” in the current context of the pandemic caused by COVID19. The research analyzes that the objectives of the laboratories that produce the COVID vaccine19, are only commercial and, once they develop the antidote, if they want to sell it at exorbitant profits, disproportionate to the acceptable cost and profit margin, the break of Compulsory patent must occur, as mechanisms to protect Human Rights. Thus, the research brings great contributions to society, since it brings legal elements for, when we confront the binomial "right to life" and "right to profit"; life, as the most important legal asset of human beings, must supplant the individual right to profit.
