1) Pietas is a Roman value. Connected to the officium (officium pietatis) acquires juridical importance and characterizes some legacies (legata pro anima, pro remedio animae, pro animae redempitione, ad pias causas). The piae causae are a compendium of assets transmitted mortis causa for the purpose of worship or charity and these too are connected to the pietas. The value of pietas in the Christian age defines the ethical status of the person. 2) The ‘provisions in favor of the soul’ are provided for in art. 629 of the Italian civil code and refer to the value of pietas. There is controversy in doctrine and jurisprudence about the character of the testamentary burden if it is accessory or autonomus. The Supreme Court of Cassation accepts the thesis of autonomy against the traditional position.
