The present essay deals with the current state and perspectives of the advisory competence of the European Court of Human Rights as provided for by Protocol no. 16, in the light of the recent opinions adopted by the Court itself. The first part of the article is dedicated to the general overview of the advisory procedure envisaged by the Protocol, through the in-depth analysis of its distinguishing features, namely, its history, origins, objectives, characteristics and lacunas. The second part of the contribution is devoted to the detailed legal examination of the cited opinions, highlighting their positive and negative aspects, also taking into consideration the aims underlying Protocol no. 16. Finally, in the third part of the article, an overall assessment of the application of the advisory instrument at issue is made and its future perspectives are outlined.
Oggetto del presente scritto è l’esame dello stato attuale e delle prospettive della competenza consultiva della Corte europea dei diritti umani così come prevista dal Protocollo n. 16, alla luce dei recenti pareri da essa adottati. La prima parte del contributo è rivolta all’inquadramento generale della procedura consultiva disciplinata dal Protocollo, attraverso l’approfondimento di una serie di elementi atti a connotarla, ovvero, la storia, le origini, gli obiettivi, le caratteristiche e le lacune. La seconda parte del lavoro è dedicata all’analisi dei pareri citati – mediante l’esame delle tematiche giuridiche da essi affrontati e dei principi di diritto negli stessi sanciti –, ponendone in risalto sia gli aspetti positivi che quelli negativi, anche e soprattutto in considerazione delle finalità sottese al Protocollo n. 16. Nella terza parte dell’articolo, infine, viene svolto un bilancio dell’applicazione dello strumento consultivo in oggetto e ne vengono delineate le prospettive future.
