The essay investigates the combination of artificial intelligence and cognitive enhancement technologies, a synergy that amplifies opportunities but also risks, mainly for the health and mental privacy of those willing to undergo the innovative practices it enables. With regard to health protection, the reflections carried out lead to the conclusion that it must constitute the limit to the individual’s request for neuroenhancement, if the requested treatment is even only potentially harmful. Regarding mental privacy, on the other hand, there is a pre-eminent need for sophisticated and constant monitoring, both by companies producing neurodevices and by the police, as well as for specific criminal legislation. In any case, protection must be constructed according to a multilevel scheme, first of all, resolving, at each regulatory level, the question of whether or not the existing provisions should be reformulated in the face of unprecedented technological developments in the sector.
Il saggio indaga il connubio tra l’intelligenza artificiale e le tecnologie di potenziamento cognitivo, sinergia che amplifica opportunità ma anche rischi, principalmente per la salute e per la riservatezza mentale di chi volesse sottoporsi alle innovative pratiche che essa consente. Sul versante della tutela della salute, le riflessioni condotte portano a concludere che essa deve costituire il limite all’istanza di neuroenhancement del singolo, ove il trattamento richiesto fosse anche solo potenzialmente dannoso. Sul versante della riservatezza mentale, si avverte invece, preminentemente, la necessità di un controllo sofisticato e costante, sia da parte delle aziende produttrici di neurodevices, sia da parte della forza pubblica, nonché di una specifica normazione penale. Ad ogni modo, la tutela va costruita secondo uno schema multilivello, sciogliendo preliminarmente, ad ogni piano normativo, l’interrogativo sull’opportunità di riformulare o meno le disposizioni vigenti, a fronte degli inediti sviluppi tecnologici nel settore.
