The essay focuses on Hegel’s conception of crime and punishment as it appears in the Elements of the Philosophy of Right. After delineating the central aspects of the Hegelian philosophy of law, attention will be given to the definition of the concept of Unrecht and its relevance for the Hegelian concept of recognition. Finally, after an analysis of the concepts of action and imputation, an attempt will be made to answer whether or not it is correct to consider Hegel a mere retributivist.

Abstract

The essay focuses on Hegel’s conception of crime and punishment as it appears in the Elements of the Philosophy of Right.
