Alcune considerazioni sugli aspetti sociali della pratica testamentaria a Roma a partire dalla lettura di Jacob Stern

The aim of this paper is to examine the social aspects of the testamentary practice in Rome during the Republican period and the Principate, starting from the work carried out by Jacob Stern in his latest monograph, where the results achieved by the Romanist doctrine in this subject are verified through the analysis of legal and, above all, literary sources. In particular, it emerges from the latter how the testamentary deed had not only the function of regulating patrimonial affairs for the period following the death of the testator, but also a strong ethical, social, political and economic value, opening up new perspectives in the study of Roman succession law, not simply based on the examination of the legislative discipline, but also extended to the disruptive impact that testamentary dispositions could have at the time on society and culture.

L’obiettivo del presente contributo è quello di vagliare gli aspetti sociali della pratica testamentaria a Roma durante l’età repubblicana e il principato, a partire dalla lettura compiuta da Jacob Stern nella sua ultima monografia, dove i risultati conseguiti dalla dottrina romanistica in materia vengono verificati attraverso l’analisi delle fonti giuridiche e, soprattutto, letterarie. In particolare, emerge da queste ultime come l’atto testamentario non avesse solo la funzione di disciplinare le vicende patrimoniali per il periodo successivo alla morte del testatore, bensì anche una forte valenza etica, sociale, politica ed economica, aprendo nuove prospettive nello studio sul diritto successorio romano, che non si fondi semplicemente sull’esame della disciplina legislativa, ma si estenda anche sulla portata dirompente che le disposizioni testamentarie potevano avere sulla società e sulla cultura dell’epoca.
