La ricostruzione del rapporto tra politica e magistratura non può prescindere dall’analisi delle leggi sull’ordinamento giudiziario. Riflettendo su questa legislazione, con particolare riguardo al Ventennio fascista, si colgono utili spunti allo studio delle esperienze giuridico-costituzionali di inizio Novecento, come pure di alcune attuali. The reconstruction of the relationship between politics and the judiciary cannot ignore the analysis of the laws on the judicial system. Reflecting on this legislation, with regard to the Fascist period, useful insights can be gathered for the study of the juridical-constitutional experiences of the early twentieth century, as well as some of the current ones.
