La tutela dinamica dell'identità personale in rete: sarà vero oblio?

The enormous potential of the new information and communication technologies for sharing personal data, whether voluntarily or involuntarily, calls for a profound reflection on the right to personal identity and its accentuated ‘dynamic’ configuration. The interest in being forgotten and, therefore, in having facts that occurred in the past and no longer correspond to the person’s current identity fall into oblivion must be protected by taking into consideration the intrinsic characteristics of the Net, highlighting all the distance that exists between the latter and human memory. Taking its starting point from a ruling by the Supreme Court, the essay intends to demonstrate how the right to be forgotten, dropped into the new phenomenological reality of the Web, is much more realistically declined as the right to de-referencing and not as the right to absolute deletion from the Web, despite the misleading heading of Article 17 of the General Data Protection Regulation (UE 2016/679).

Le enormi potenzialità di condivisione, volontarie o involontarie, di dati personali, delle nuove tecnologie dell’informazione e della comunicazione impongono una profonda riflessione sul diritto all’identità personale e sulla sua accentuata “dinamica” configurazione. L’interesse ad essere dimenticati e, quindi, a far cadere nell’oblio fatti accaduti in passato e non piú rispondenti all’attuale identità della persona deve essere tutelato tenendo in considerazione le caratteristiche intrinseche della Rete, evidenziando tutta la distanza che intercorre tra quest’ultima e la memoria umana. Prendendo le mosse da una pronuncia della Suprema Corte, si intende dimostrare come il diritto all’oblio, calato nella nuova realtà fenomenologica della Rete, si declini molto piú realisticamente come diritto alla deindicizzazione e non come diritto alla cancellazione assoluta dal web, nonostante la rubrica dell’art. 17 del reg. (UE) 2016/679.
