La nota esamina il profilo dell’accesso alla composizione negoziata della crisi, che viene negato all’imprenditore che versi in una situazione di insolvenza irreversibile, come assunta nel contesto del procedimento giudiziario in tema di misure protettive; nonché delle caratteristiche che assume la valutazione del Giudice per la revoca delle misure protettive richieste dal debitore.
