The article investigates a possible legal transplant, in the Italian legal system of partnership law, of the actio pro socio, recently introduced in Germany by a statute law (new § 715b-Gesellschafterklage BGB after the German Act to modernise the law on partnership — Gesetz zur Modernisierung des Personengesellschaftsrechts — MoPeG); remedy already provided by French statute law as action sociale ut singuli and by some common law systems as derivative action.
