This article examines the legal status of third-country students and researchers within the European Union in light of Directive (EU) 2016/801, contextualizing it within the structural tension between the strategic objective of attracting talent to enhance the competitiveness of the knowledge economy, and persistent security-driven demands for migration management. Despite significant advancements regarding intra-EU mobility, procedural guarantees, and judicial protection, the regulatory framework maintains a pronounced selectivity and a “hierarchization” that privileges researchers over students. Furthermore, the effectiveness of the Directive clashes with the administrative discretion exercised by Member States – as demonstrated by the analysis of specific practices within the Italian legal system – and the surreptitious introduction of additional admission requirements. Lastly, the study assesses the impact of the principles concerning the prohibition of abusive practices and threats to public security, outlining reform perspectives and the risk that future institutionalized screening mechanisms may lead to academic protectionism, ultimately cooperation.
Il contributo analizza lo status giuridico di studenti e ricercatori di Paesi terzi nell’Unione europea alla luce della direttiva 2016/801/UE, nel quadro della tensione strutturale tra l’obiettivo strategico di attrarre talenti per accrescere la competitività della conoscenza e le persistenti istanze di matrice securitaria e di controllo dei flussi migratori. Nonostante i significativi avanzamenti sul piano della mobilità intra UE, dei diritti procedurali e delle tutele giurisdizionali, l’impianto normativo conserva una marcata selettività e una “gerarchizzazione” che favorisce i ricercatori rispetto agli studenti. L’effettività della direttiva si scontra, inoltre, con la discrezionalità amministrativa degli Stati membri – come dimostrato dall’analisi di alcune prassi nell’ordinamento italiano – e con l’introduzione di surrettizie condizioni aggiuntive all’ammissione. Infine, il contributo esamina l’impatto dei principi del divieto di pratiche abusive e della minaccia alla sicurezza pubblica, delineando le prospettive di riforma e il rischio che future misure di screening istituzionalizzato possano sfociare in un protezionismo accademico a scapito della cooperazione scientifica internazionale.
