In the neurotechnological era, the convergence of mind intervention techniques and artificial intelligence systems poses simultaneous risks to both individual cognitive securit y and State security. Techniques that record, modulate, or alter neural activity thereby influencing thought formation and extracting information ultimately undermine personal identity, the inviolable core of the individual, as well as the capacity for autonomous self determination. When such interventions target the political will or the minds of individuals holding high level decision making roles or compromise the confidentiality of the information known to them, the impact extends beyond the personal sphere. Accordingly, they pose, respectively, a threat to popular sovereignty and democratic legitimacy on the one hand, and to strategic interests and national stability on the other. This article advocates a systemic understanding of the link between individual neurointegrity and institutional resilience, emphasizing the need for multi layered protection of neurorights and, in particular, for the safeg uarding of mental integrity as a foundational prerequisite for the endurance of democratic systems.
Nell’era neurotecnologica, la convergenza tra tecniche d’intervento sulla mente e sistemi d’intelligenza artificiale costituisce un fattore di rischio simultaneo per la sicurezza cognitiva individuale e per quella dello Stato. Le tecniche capaci di registrare, modulare o alterare l’attività neurale, incidendo sulla formazione del pensiero e inf erendone informazioni, finiscono con il compromettere l’identità personale, nucleo inviolabile della persona, oltre alla stessa possibilità di una successiva, libera autodeterminazione. Quando tali interferenze colpiscono la sfera della volontà politica o la mente di soggetti con responsabilità decisionali elevate, la lesione trascende l’ambito individuale per incidere, ora sulla genuinità del voto e delle determinazioni politiche, ora sull’autenticità delle decisioni assunte da chi esercita funzioni strate giche o sulla segretezza delle informazioni da questi conosciute. Sicché essa si trasforma, rispettivamente, in minaccia alla sovranità popolare e alla legittimità democratica, nonché in compromissione degli interessi strategici e della stabilità nazionale . L’articolo propone, dunque, una lettura sistemica del nesso tra integrità neurocognitiva della persona e resilienza istituzionale, affermando la necessità di una tutela multilivello dei neurodiritti e, in particolare, della protezione dell’integrità mentale, quale presupposto della tenuta degli ordinamenti democratici.
