The paper focuses on the issue of land take, proposing a critical review of the institutional actions implemented at national level to deal with the phenomenon. If we consider that land use decisions are generally taken on a local scale, within contexts that can differ considerably from a political, legal and socio-economic point of view, we can easily understand why the strategies and policy tools adopted are characterized by a great heterogeneity, a heterogeneity which is highest in countries like Italy, where there is a lack of strong and credible public policies, capable of regulating ex ante and controlling ex post the local choices of territorial governance. Within this framework, particular attention is dedicated to the intervention models proposed by the national laws and regional rules and the underlying vision.
