The analysis of the relationship between insolvency settlements and individual enforcement procedures shows, on the one hand, that the regulatory models of forced sales - the code model and the one envisaged by the CCII - offer substantially equivalent results, both in terms of effectiveness and guarantees; and, on the other hand, that the interference induced by the opening of the liquidation procedures on the individual enforcement procedures cannot be traced back to a unitary systematic matrix, both in terms of the procedural methods and of the effects.
L’analisi dei rapporti tra liquidazioni concorsuali e procedure esecutive individuali mostra, da un lato, che i modelli normativi della vendita forzata - quello codicistico e quello previsto dal CCII - offrono risultati sostanzialmente equivalenti, tanto sul piano dell’efficacia, che delle garanzie; e, dall’altro lato, che le interferenze indotte dall’apertura delle procedure di liquidazione sulle procedure esecutive non sono riconducibili ad una matrice sistematica unitaria, tanto sul piano delle modalità processuali che degli effetti.
