The intervention represents an attempt, albeit carried out with a secondary provision, to stem, through a series of adjustments and technical implementation specifications, the application problems that arose following the entry into force of legislative decree no. 92 of 4 July 2024, which, aimed at easing the workload of the supervisory judiciary, has created practical management problems and highlighted aspects of unconstitutionality.
Il d.p.r. n. 176/2025 ha apportato modifiche al d.p.r. 30 giugno 2000, n. 230, Regolamento recante norme sull’ordinamento penitenziario e sulle misure privative e limitative della libertà, in materia di cartella personale, di informazioni dell’ufficio penale esecuzione esterna, di detenzione domiciliare, di riduzioni di pena per la liberazione anticipata, di corrispondenza telefonica. L’intervento rappresenta un tentativo, anche se effettuato con una norma di rango secondario, di arginare, con una serie di aggiusti e specificazioni tecniche esecutive, i problemi applicativi sorti a seguito dell’entrata in vigore del d.l. 4 luglio 2024, n. 92, che, teso ad alleggerire il carico di lavoro della magistratura di sorveglianza, ha creato problemi pratici di gestione ed evidenziato profili di incostituzionalità.
