With a new additive ruling, the Constitutional Court has written yet another chapter in the trajectory of the vertical incompatibility of the enforcement judge, now extended to cases in which the order granting or rejecting a request to revoke a final judgment for breach of the ne bis in idem principle is annulled with referral by the Court of Cassa-tion. The decisum confirms the judiciary’s progressive acknowledgment of the cognitive nature of the scrutiny inherent in the power to intervene in res judicata; a development that forcefully brings back to the forefront the issue of impartiality of executive jurisdiction, an area not safeguarded by any functional incompatibility between the judge who rendered the original decision and the enforcement judge.

Abstract
With a new additive ruling, the Constitutional Court has written yet another chapter in the trajectory of the vertical incompatibility of the enforcement judge, now extended to cases in which the order granting or rejecting a request to revoke a final judgment for breach of the ne bis in idem principle is annulled with referral by the Court of Cassa-tion. The decisum confirms the judiciary’s progressive acknowledgment of the cognitive nature of the scrutiny inherent in the power to intervene in res judicata; a development that forcefully brings back to the forefront the issue of impartiality of executive jurisdiction, an area not safeguarded by any functional incompatibility between the judge who rendered the original decision and the enforcement judge.I documenti in IRIS sono protetti da copyright e tutti i diritti sono riservati, salvo diversa indicazione.
