This paper aims to outline the notion of “victim of trafficking” in the Council of Europe’s human rights protection system, through a critical analysis of the Strasbourg Court’s case law. Then it focuses on e-trafficking and the emerging critical issues in combating trafficking in the broader European context. Finally, it highlights that the integration of ECHR standards into national legal systems places the victim at the center of the security system, rather than the repression of crime.
Il presente contributo intende delineare la nozione di “vittima di tratta” nel sistema di protezione dei diritti umani del Consiglio d’Europa, attraverso un’analisi critica della giurisprudenza della Corte di Strasburgo, per poi soffermarsi sull’e-trafficking e sulle criticità emergenti nell’azione di contrasto alla tratta nel più ampio contesto europeo, evidenziando, infine, come l’integrazione degli standard CEDU negli ordinamenti nazionali pone la vittima al centro del sistema di sicurezza, piuttosto che la repressione del reato in sé.
